1. General Rules
To use the services provided by newcrush.com, you must:
• Be at least fourteen (14) years old.
• Complete the registration form, create an account using third-party services or use the services as a "guest."
• Familiarise yourself with the Privacy Policy and website usage rules.
By registering on our website or otherwise using our services, you confirm that you have read the Privacy Policy, agree with it and grant us the right to collect, store, organise, use and process all personal data listed herein for the purposes as specified in the Privacy Policy.
We do not allow accounts primarily intended to promote harm, encourage discrimination, spread hate or distribute offensive content. Therefore, we reserve the right to suspend your membership, delete your account or otherwise prevent access to our website if we feel it is necessary to do so.
These terms and conditions of purchase and sale constitute a purchase and sale contract between the Buyer and UAB Bioklinika (Newcrush).
The Buyer cannot purchase goods until they have reviewed these rules.
The Seller has the right to restrict the Buyer's rights on the site.
The Seller owns all intellectual property rights to the website content.
1.1 Product Reviews
The website allows users to leave product reviews. To avoid potential issues, spam and other harmful activities, reviews must be reviewed and approved by an administrator.
Customers can leave a review only for products they have purchased. Reviews can only be left by registered users of newcrush.com.
For a review to be approved, it must be constructive, explaining what you liked or did not like about the product. We reserve the right not to publish reviews that are not informative or do not reflect reality and established legal standards. Approved reviews may earn loyalty points for registered users. Your review may be used for advertising purposes.
Attention: Any product review you leave is considered advertising and must comply with the Lithuanian Law on Advertising. According to Article 1, Paragraph 8 of the Law on Advertising of the Republic of Lithuania: "Advertising is any form and means of disseminating information related to a person's commercial-economic, financial, or professional activities, encouraging the purchase of goods or use of services." Therefore, user reviews are treated as advertising and must meet the requirements set out for advertising.
2. General Provisions
These Terms and Conditions of Purchase and Sale (hereinafter referred to as the "Rules") establish the general conditions and procedures for using the NEWCRUSH online store at newcrush.com (hereinafter referred to as the "Store"). The Rules apply when Buyers select, order and purchase goods offered by the Seller in the Store or use the services provided by the Store.
Only individuals registered with the Store or using the guest function (hereinafter referred to as the "Buyer") have the right to purchase from the Store. By registering with the Store and/or placing an order, the Buyer unconditionally confirms that they have the right to purchase from the Store. The Buyer is not granted the right to place an order if they have not read and agreed to the Rules.
The Seller reserves the right to unilaterally change, modify, or supplement the Rules. The Rules applicable at the time of placing the order apply to purchases made in the Store, so the Buyer is advised to review the Rules with each purchase.
The Seller reserves the right to limit the number of registered Buyers due to the Store's technical capacity; to restrict the Buyer's access to the Store's services or cancel the Buyer's registration if the Buyer has used the Store in violation of these Rules or attempted to harm the Store's operations or security; and to discontinue the Store’s operations temporarily or permanently without prior notice to the Buyer. In the event of force majeure, the Seller has the right to suspend the execution of the contract until the force majeure circumstances cease.
3. Orders, Registration, Login Details
In the purchase form, the Buyer must provide the following details:
• Individual - first and last name.
• Legal entity - legal entity name, code and VAT code.
• Email address.
• Delivery address unless the Buyer collects the goods themselves.
• Contact phone number.
The Buyer is responsible for ensuring that the registration details provided are accurate and complete. If the information changes, the Buyer must update it before the next order. The Seller is not liable for any damage caused by incorrect information provided by the Buyer.
The Buyer is responsible for keeping their username and password confidential. The Buyer is responsible for actions taken in the Store using their login details.
By registering, the Buyer grants the Seller the right to collect, store, use and process the personal data provided by the Buyer for the purposes specified in the Rules. The Seller ensures that the personal data provided by the Buyer will be used exclusively by the Seller and its partners involved in administering the Store, delivering goods and providing other services related to the Store.
4. Product Prices and Discounts
Product prices in the Store are indicated in Euros, including VAT.
Discount codes are valid only in the newcrush.com store, unless otherwise specified. Only one discount code can be used per purchase. Discounts do not apply to promotional items.
The Buyer must pay for the selected goods using the specified payment methods. If the Buyer does not pay for the goods within 5 working days from the order date, the Seller reserves the right to cancel the order without prior notice.
5. Payment Methods
You can pay for the goods purchased at the Newcrush.com/lt/ online store using:
• E-banking through most major Lithuanian banks via https://opay.eu/lt.
• Credit cards - VISA, MASTERCARD via https://stripe.com/en-lt.
• NEWCRUSH Gift Card.
6. Product Quality Guarantee and Expiration Dates
All product features are generally specified in the product description.
The Seller is responsible for the sale of the goods ordered in the Store, the proper delivery of the purchased goods, the proper fulfillment of return conditions and the implementation of other rights and obligations specified by law.
The Seller confirms that it is responsible for any discrepancies in the appearance of the goods caused by the Seller or related third parties. In such cases, the Seller is liable for any discrepancies in the appearance of the product.
7. Delivery and Pickup of Goods
Goods purchased in the Store are delivered by the shipping companies chosen by the Buyer, except in cases where the Buyer picks up the goods themselves.
The delivery time once the shipment is handed over to the shipping company, depends on the shipping company, which the Seller cannot influence. Delivery methods and pricing can be found here.
The Buyer can collect the goods from Islandijos pl. 7, Kaunas. The goods are stored for 5 working days from the order confirmation date. If the goods are not collected within the specified timescale, the order will be cancelled unless otherwise agreed with the Seller.
8. Contract Withdrawal, Returns and Exchanges
The Buyer has the right to withdraw from the contract and return the goods purchased online within 14 days under the conditions set by the Civil Code of the Republic of Lithuania and other legal acts.
To withdraw from the contract and return the goods, the Buyer must contact the Seller via email at labas@newcrush.com and provide a clear statement of the return, including their name, address, phone number, purchase date along with the names and quantities of the goods to be returned.
When returning goods, the Buyer must ensure that the quality, packaging, and compliance with safety and hygiene requirements have not changed. The Buyer is responsible for any reduction in the value of the goods due to actions that were not necessary to establish the nature, characteristics and functionality of the goods.
Returned goods must be accompanied by the purchase document and the completed return document. The Buyer must pay the return shipping costs.
